By downloading, installing, or using Monty ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. About Monty

Monty is a personal wellness journaling app that helps you track daily health data and identify patterns using AI analysis. It is designed for informational and educational purposes only. Monty is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use. All rights not expressly granted are reserved by us.

3. Eligibility

You must be at least 16 years of age to use Monty. By using the App, you represent and warrant that you meet this age requirement.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your login information.

5. Subscriptions & Billing

Monty offers both free and premium (Monty Pro) features. Premium features require a paid subscription.

• Pricing: Monty Pro is available at $6.99 per month or $36.99 per year.
• Free Trial: New users receive a 3-day free trial of Monty Pro. At the end of the trial, you will be automatically charged the subscription price unless you cancel at least 24 hours before the trial ends.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions.
• Free trial eligibility is available once per Apple ID.
• No refunds are provided for partial billing periods. Refund requests must be made through Apple.
• Prices may change with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

6. Medical Disclaimer

• Monty is not a substitute for professional medical advice, diagnosis, or treatment.
• Never disregard professional medical advice or delay seeking it because of information from this app.
• AI-generated recommendations are general wellness suggestions based on statistical patterns in your self-reported data. They are not clinically validated or peer-reviewed.
• If you have a medical emergency, call your local emergency number immediately.
• Monty has not been evaluated or approved by the FDA or any regulatory body.
• The app does not diagnose, treat, cure, or prevent any disease or medical condition.
• The app is not intended for self-diagnosis.
• You assume all risk associated with acting on AI-generated recommendations. You agree to hold Monty and its developers harmless from any claims, damages, or losses arising from health decisions made based on information provided by the App.

7. Your Responsibilities

• You are responsible for the accuracy of the data you enter.
• You should not rely solely on Monty for health decisions.
• You agree to use the App only for its intended purpose as a personal wellness journaling tool.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, or create derivative works based on the App.
• Remove, alter, or obscure any proprietary notices in the App.
• Use the App in a manner that could damage, disable, or impair our services.
• Attempt to gain unauthorized access to any part of the App or its systems.

9. AI Features

• AI features use OpenAI's technology to analyze patterns in your data.
• AI responses may be inaccurate, incomplete, or inappropriate.
• Correlations identified by AI do not imply causation.
• We do not guarantee the accuracy or reliability of AI-generated content.
• AI outputs are generated algorithmically and have not been reviewed by medical professionals.
• AI features are optional. You may use Monty for health logging without using AI features.

10. Intellectual Property

The App, including all content, features, functionality, design, text, graphics, logos, and software, is owned by Monty Health and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited license in Section 2.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no representations about the accuracy, completeness, or usefulness of any information provided through the App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTY AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Monty Health and its developers, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) any health decisions you make based on information provided by the App; or (d) your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your license to use the App is immediately revoked. You may delete your account and all associated data at any time from your Profile settings. Sections 6, 11, 12, 13, and 16 survive termination.

15. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

17. General Provisions

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Monty Health regarding the App.
• Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
